North Carolina Man Arrested For Interference With Custody

Passaic County Prosecutor Camelia M. Valdes, Paterson Police Department Officer-In-Charge Isa Abbassi, and United States Marshal Juan Mattos announce the apprehension and arrest of Anthony Smith, age 47, from Cary, North Carolina. Mr. Smith was arrested without incident on June 7, 2024, by members of the United States Marshals Service, after an investigation conducted by the Paterson Police Department in conjunction with the Passaic County Prosecutor’s Office. Anthony Smith is charged with second degree Interference with Custody.

On May 28, 2024, members of the Paterson Police Department were dispatched to the area of East 27th Street and 21st Avenue on a report of a custody dispute. A Paterson resident reported that the father of her 10-month-old daughter had not returned the child to her on May 26, 2024, pursuant to their court-ordered visitation agreement. On June 5, 2024, after an investigation by the Paterson Police Department and the Passaic County Prosecutor’s Office, a warrant was issued for Anthony Smith’s arrest. On June 7, 2024, members of the United States Marshals Service apprehended Anthony Smith in North Carolina. The child was found in good health and was reunited with her mother. The defendant is pending extradition to New Jersey.

The sentencing exposure on second degree Interference with Custody is 5 to 10 years in New Jersey State Prison.

A criminal complaint is merely an accusation. Despite this accusation, defendants are presumed innocent unless and until proven guilty beyond a reasonable doubt.
