Teacher's Aide Charged With Endangering the Welfare of a Child

Passaic County Prosecutor Camelia M. Valdes and Paterson Police Department Officerin-Charge Isa Abbassi announce the arrest of Favio Martell, of Garfield, New Jersey. Mr. Martell was arrested on September 6, 2023, after an investigation conducted by the Passaic County Prosecutor’s Office Special Victims Unit and the Paterson Police Department.

On September 1, 2023, the Paterson Police Department advised Special Victims Unit Detectives that a 14-year-old student at the Paterson Arts & Sciences Charter School had received a sexually explicit picture from Mr. Martell, a teacher’s aide and soccer coach at the school. The investigation led to Mr. Martell being charged with one count of third degree Endangering the Welfare of a Child, in violation of N.J.S. 2C:24-4a(1).

The sentencing exposure is three to five years in New Jersey State Prison on third degree Endangering the Welfare of a Child. On September 7, 2023, Mr. Martell appeared for Central Judicial Processing proceedings and was released pending trial on monitoring, with special release conditions that he be prohibited from contact with any minor children.

A criminal complaint is merely an accusation. Despite the accusation, defendants are presumed innocent unless and until proven guilty beyond a reasonable doubt, in a court of law.
